1. About the service

Alma (talktoalma.com) is an AI-powered emotional wellness companion service operated by an individual based in Brazil. By using the service, you agree to these Terms of Use and our Privacy Policy. Alma is designed for emotional wellness and reflective listening purposes only.

2. Not a mental health service

Alma is NOT a mental health service, psychotherapy, or medical care. It does not diagnose, treat, cure, or prevent any mental health condition or disorder. It does not substitute for the care of licensed psychologists, psychiatrists, counselors, social workers, or other health professionals. No statement made by Alma should be construed as professional mental health advice.

If you are experiencing a psychiatric emergency, suicidal thoughts, or intent to harm yourself or others, please call 911 or go to your nearest emergency room immediately. You may also call or text 988 (Suicide & Crisis Lifeline, free, 24/7) or text HOME to 741741 (Crisis Text Line).

3. State-specific notices (United States)

Illinois residents: Under Illinois law (effective 2025), AI systems are prohibited from directly interacting with clients in any form of therapeutic communication in therapy or psychotherapy settings. Alma is not a therapy or psychotherapy platform, and Illinois residents use this service solely as an emotional wellness tool, not in any therapeutic or clinical context.

California residents (SB 243): In compliance with California SB 243 (effective January 1, 2026), Alma discloses that you are interacting with an AI companion, not a human being. Crisis prevention protocols are in place. A private right of action exists under SB 243 for violations — we take this seriously and maintain full compliance.

New York residents: In compliance with the New York AI Companion Models Law (effective November 5, 2025), Alma provides clear AI disclosure at the start of each session and follows crisis-response protocols for signs of serious distress.

Washington State residents: In compliance with Washington's AI companion chatbot law (2026), Alma provides AI reminders during extended sessions and does not engage in manipulative techniques designed to prolong emotional dependence.

Nevada and Utah residents: Alma does not represent itself as a mental health provider. It is an emotional wellness companion tool only.

4. AI disclosure

You acknowledge and understand that Alma is an artificial intelligence system, not a human being. All responses are generated by AI (Anthropic Claude). You are never communicating with a human during your session. A disclosure notice is shown at the start of every session, with periodic reminders during extended use.

5. Eligibility and age

The service is intended exclusively for users 18 years of age or older. Use of the service by anyone under 18 is strictly prohibited. By using Alma, you represent that you are 18 years of age or older. We do not knowingly allow minors to use this service.

6. Acceptable use

You agree not to use Alma for any unlawful purpose; to share personal information of third parties without their consent; to attempt to compromise the security or integrity of the platform; to use the service in any way that could cause harm to yourself or others; or to attempt to circumvent the age restriction.

7. Free and Premium plan

The free plan offers 20 messages per day, renewed daily, with no sign-up required. The Premium plan offers unlimited access via a monthly subscription. Pricing and conditions may be modified with prior notice. Subscription payments are processed by Stripe and subject to Stripe's terms of service. You may cancel your subscription at any time by contacting contact.almasupport@gmail.com.

8. Intellectual property

All content on the platform, including text, design, code, and branding, is the property of Alma. Reproduction without express written authorization is prohibited.

9. Availability

We strive to keep the service available 24 hours a day, but do not guarantee uninterrupted availability. Maintenance may be performed without prior notice.

10. Limitation of liability

To the fullest extent permitted by applicable law, Alma and its operators shall not be liable for any decisions made based on conversations conducted on the platform. The service is provided as a complementary emotional wellness tool only. Your use of Alma is at your sole risk. Our maximum liability, under any circumstances, shall not exceed the amount paid by you in the month in which the alleged harm occurred.

11. Governing law and dispute resolution

These Terms shall be governed by the laws of the United States and the State of Florida, without regard to conflict of law provisions. Any disputes arising from these Terms shall be subject to binding arbitration under the rules of the American Arbitration Association. Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction.

12. Changes to terms

We may update these Terms at any time. Material changes will be communicated via a notice on the site at least 15 days in advance for active Premium subscribers. Continued use of the service after changes constitutes acceptance of the new terms.
